TERMS AND CONDITIONS OF OUTSTANDING BINS

This Agreement governing the terms and conditions of your use of Outstanding Bins Trash Bin Cleaning service, is between you (“you” or “Customer”), as an authorized user of such services. These terms of service, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Outstanding Bins on its website these terms constitute the entire agreement between Outstanding Bins and you regarding the Services as defined in this Agreement. By using the Services, you agree to be bound by these terms and condition.

SERVICES:

Outstanding Bins provides on-site curbside residential and commercial cleaning and commercial cleaning services for your municipally issued trash and recycling bins.

Responsibilities of Customer:

To avoid an interruption or discontinuation of Services, you must do all the following:

1. Trash bin (s) must be empty and available by the curb or alley on your scheduled Trash CAN cleaning date.
2. Trash bin (s) must be free of all trash and animal waste.
3. Trash bin (s) must be free of chemicals, oils, any petroleum-based products, oil-based paint, glue or other adhesive, or hazardous waste of any kind.
4. Trash bin (s) must be free of building materials, e.g., plaster, stucco, or concrete.

If you fail to observe the conditions listed above, we have the right to refuse providing you with the Services, but you will still be responsible for all payments/fees relating thereto. You may reschedule your Services but will be billed for an additional service visit.

Responsibilities of Outstanding Bins:

If Outstanding Bins fails to provide its service(s) on the scheduled day of service for any reason other than your failure to meet the obligations as outlined in Responsibility of Customers, we will compensate the Customer by arranging for the service to be performed on the next weekly day after trash pick-up. If we are unable to provide your Services due to inclement weather, we will make good faith efforts to reschedule your Services.

Modification of Terms of Services:

Outstanding Bins reserves the right to modify the Services at any time and without notice to you. These terms and Conditions may be amended and/or revised at any time by Outstanding Bins by posting an amended and/or revised version of the same on our website (www.outstandingbins.org), or delivering a copy of the amended or revised term and conditions to your email address of record. All amendments and/or revisions are intended to improve our ability to provide Services.

Payments: 

Customers agree to pay all charges for use of the service(s) package selected. Charges quoted will not include sales or other taxes, except as required by State Laws. Outstanding Bins reserves the right to adjust prices or institute new charges for services. Any changes in pricing will be communicated to customers by mail OR email. In the event of pricing adjustment customers has the rights to continue or discontinue services.

1. Payment for your Outstanding Bins Cleaning services will be automatically charged to your Debit card, Credit card account on file.
2. Charges are to be paid on a monthly, bi-monthly, quarterly, and one-time basis. If payments are not received within 48 hours after services has been render or debit card (or its agent or affiliate), customer agrees to pay all amounts due upon demand by Outstanding Bins LLC.
3. Credit card will be charged after service have been completed
4. No personal checks will be accepted.

Customer must notify Outstanding Bins of any changes to Customer’s Payment Method prior to the next billing cycle. A late fee of $15 will be added to any Fees that are more than 10 days past due.

Any Customer account that is more than 30 days past due will be considered delinquent. Services for delinquent accounts will be suspended until the account balance has been restored to good standing.

Default Payments:

Outstanding Bins Cleaning Service reserves the right to suspend or terminate services without notice upon rejection of any credit or debit card charges. In the event your card issuer (or its agent or affiliate) seeks return of payments previously made to Outstanding Bins LLC and if Outstanding Bins believes you are liable for the charges customers will be required to pay the full cost for services and any additional charges or fees.

Prepaid Services:

You must provide 30 days’ notice if you desire to cancel Services. If you do not provide 30 days’ notice of your intention to cancel Services, you will not be refunded for any prepaid Services. For example, if you select Monthly Service, Quarterly Payment and cancel your Service after the first month but less than 30 days before your second scheduled Service, you will be refunded $22 for the Services not received.

If you choose a monthly service plan, you agree to a 3-month minimum contract and your plan will auto-renew each month. To cancel your services, you must provide 30 days’ notice as set forth above.

General:

Choice of Law Jurisdiction and Forum:

• This agreement shall be governed by laws provision specifies in the state of Georgia for any litigation that arise from the contract by the Dekalb County Georgia Superior Court.

Attorney’s Fees and Costs:

• In the event that either party is required to retain the services of an attorney to enforce this Agreement or to defend against any cause of action, claim, or counterclaim brought by the other party pursuant to this Agreement, then the prevailing party will be entitled to recover the attorney’s fees and costs which it has incurred, in addition to other remedies to which it is entitled under applicable law, unless the adjudicator specifically finds that neither party is the prevailing party.

Force Majeure:

•  Other than obligations regarding payments, neither party shall be in default or otherwise liable for any delay or failure to perform under this Agreement if such delay or failure is caused by an event beyond its reasonable control, including, but not limited to, any act of God, act of a common enemy, the elements, earthquakes, floods, fires, epidemics, or war.

Severability: 

•  Should any paragraph of this TOS be determined to be contrary to law, the remainder of the Term and Conditions shall be interpreted in such a manner as if the omitted portion had not been included.
